The CSP uses these criminal record check results as part of their overall assessment, along with other considerations. Federal law requires that each state must have at least one “expert fingerprint examiner” available to process FBI fingerprint requests. If an examiner is not available, a state law fingerprinting agency may make a state-certified fingerprint examiner available for the FBI, after consulting with the FBI.
